This page sets out the terms on which THE FRUITFUL YIELD, INC. (EIN 36-2792168), trading as THE FRUITFUL YIELD INC, sells products through fruitprobe.com. Reading it is worthwhile: placing an order means accepting it. Where the words “we” or “us” appear below they mean THE FRUITFUL YIELD, INC..

1. Agreeing to this

Browsing the site, buying from it, or asking for our text or email messages all count as accepting these terms and the Privacy Policy. If any part of them does not suit you, the remedy is simply not to use the site, and nothing is owed either way.

2. Who may buy

This website is for adults. You must be 18 or over to order, and 18 or over to consent to messages from us. Using the site is your representation that you are, and that you are legally able to enter into a contract.

3. What we sell, and what it is not

Everything on this site, Shop Shelf included, is a dietary supplement rather than a medicine. None of it is intended to diagnose, treat, cure, or prevent any disease or medical condition, and we will not describe it as though it were. These statements have not been evaluated by the Food and Drug Administration (FDA). Responses differ between people and no outcome is promised. Speak to a qualified healthcare professional before you begin.

4. Consent to receive text messages

Where you give a mobile number and tick the consent box, you are agreeing under the Telephone Consumer Protection Act (TCPA) that THE FRUITFUL YIELD INC may send you recurring automated marketing and informational text messages at that number. What that commits each side to is set out below.

  • Consent is not a condition of purchase.
  • Frequency is not fixed and varies with promotions and activity.
  • Message and data rates may apply.
  • Reply STOP at any time to end the messages.
  • Reply HELP at any time to reach support.
  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

5. The guarantee

30 days from delivery to change your mind, opened or unopened, with no restocking charge and no explanation required. Contact info@fruitprobe.com to open it. Refunds return to the original payment method within 5 to 10 business days of the goods getting back to us.

6. Copyright and trade marks

Everything published here is owned by THE FRUITFUL YIELD, INC. or used under licence. You are welcome to read it, quote it fairly and link to it; you may not reproduce it wholesale, redistribute it or adapt it into another work without our prior written consent.

7. What we are and are not answerable for

THE FRUITFUL YIELD, INC. stands behind the products it sells and will put right what it gets wrong, up to the amount you paid for the product concerned. Beyond that, and to the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages.

8. Jurisdiction

Any question about these terms is decided under Illinois law and in the courts of Illinois, without reference to conflict-of-law principles. Nothing here limits the statutory rights you have where you live.

9. Amendments

We reserve the right to amend this page. Amendments take effect on publication, carry a revised date, and apply to use of the site from then on. An order already placed stays governed by the version in force at the time.

11. Shelf prices, stock and lot records

  • Shelf prices are what the delivery cost plus one markup applied identically across the shop, as described on the front page. No category subsidises another.
  • Prices follow the cost of the next delivery and move down as well as up. A change applies from the day new stock is booked in and never backwards to a purchase already made.
  • Weekly offers are a genuine reduction against the shelf price, for a stated week and a stated item, and end when the week does.
  • Stock is finite. Where an item sells out after you order it, we say so the same working day and refund in full rather than substituting something we judge to be close.
  • Lot numbers are recorded against sales so that a withdrawal can reach the people who received the affected batch. In that event THE FRUITFUL YIELD, INC. contacts you, refunds in full, and does not require the product to be returned first.
  • THE FRUITFUL YIELD, INC. may decline or cancel an order, refunding it in full, where it appears to be for commercial resale or where payment cannot be verified.
  • Your home state's consumer protections apply regardless of this page. Where the two differ, whichever is better for you applies.
